When a person passes away, it will often be necessary to bring proceedings in the Surrogate's Court so that a fiduciary is given authority to collect (marshal) the decedent's property, pay off creditors, and distribute assets to heirs and other beneficiaries. When the decedent has a will, this will be done through probate proceedings, and when they die without a will, this will be done through administration proceedings.
